המידע שלך שייך לך. אנחנו משתמשים בו רק כדי להפעיל עבורך את השירות, כמתואר במדיניות הפרטיות.

1. כללי
תנאים אלה חלים על השימוש באפליקציית GutPal ובשירותים הקשורים בה (״השירות״), שמפעילה GutPal LTD, ח״פ
517387551 (״GutPal״, ״אנחנו״). השימוש בשירות מהווה הסכמה לתנאים אלה ולמדיניות
הפרטיות, שהיא חלק מהם. אם אינך מסכים/ה לתנאים — אין להשתמש בשירות. התנאים מנוסחים בלשון זכר מטעמי נוחות
בלבד, והם מתייחסים לכל המגדרים.
2. מה השירות — ומה הוא אינו
GutPal מאפשר לתעד צ׳ק-אין יומי, ארוחות ותרופות, להשוות את המצב היומי לטווח האישי שלך, לקבל תזכורות, ולהפיק סיכום
מסודר לשיחה עם הרופא.
GutPal אינו שירות רפואי ואינו מכשיר רפואי. הוא אינו מאבחן, אינו קובע מצב רפואי או את פעילות
המחלה, ואינו ממליץ להתחיל, להפסיק או לשנות טיפול או מינון. הסטטוס היומי (״יציב״, ״רגיש״, ״דורש תשומת לב״) הוא
סיכום של הדיווחים שלך בהשוואה להיסטוריה שלך — לא קביעה רפואית. אין לדחות פנייה לרופא, להתעלם מייעוץ רפואי או
לשנות טיפול על סמך האפליקציה. בכל שאלה רפואית — פנה לרופא המטפל. במצב חירום — מד״א 101 או חדר
מיון.
השירות אינו מבטיח שיפור, מניעה או הקלה בתסמינים, ואינו מחליף מעקב רפואי.
3. מי רשאי להשתמש
השירות מיועד לבני 18 ומעלה. השימוש מותר לאדם פרטי, לצורך מעקב אישי אחר בריאותו בלבד. אין לפתוח חשבון
עבור אדם אחר או בשמו.
4. החשבון שלך
יש למסור פרטים נכונים בעת ההרשמה ולעדכן אותם במידת הצורך.
האחריות לשמירת סודיות הסיסמה ופרטי הכניסה מוטלת עליך. אל תשתף אותם עם אחרים.
לנסות לגשת למידע של משתמש אחר, לעקוף אמצעי אבטחה או לשבש את פעולת השירות.
להפעיל כלים אוטומטיים לאיסוף מידע מהשירות, או לבצע הנדסה לאחור של האפליקציה, אלא במידה שהחוק מתיר זאת במפורש.
להעלות תוכן בלתי חוקי, פוגעני או מידע על אדם אחר ללא הסכמתו.
להשתמש בשירות לכל מטרה מסחרית או בניגוד לדין.
6. המידע שלך
המידע שאת/ה מזין/ה בשירות שייך לך. את/ה מעניק/ה לנו רשות מוגבלת להשתמש בו רק לצורך הפעלת השירות עבורך, אבטחתו
ועמידה בדין — כמפורט במדיניות הפרטיות. אפשר לייצא את כל המידע או למחוק אותו בכל רגע (עוד ←
הגדרות). איננו מוכרים את המידע ואיננו משתמשים בו לפרסום.
7. תובנות ובינה מלאכותית
חלק מהתכונות — זיהוי מזון מתמונה, חילוץ רכיבים מתיאור ארוחה, ניסוח המלצות תזונה והצעת שאלות לרופא — נעזרות
בבינה מלאכותית ובכללים אוטומטיים. התוצאות עלולות להיות לא מדויקות או לא שלמות: מזון עלול להיות מזוהה בטעות,
והמלצות מבוססות על הדפוסים שדיווחת ואינן ייעוץ תזונתי. כל תובנה מוצגת עם ההבהרה ״זה אינו ייעוץ רפואי — שתף את
הרופא שלך״. יש לבדוק כל מידע כזה מול שיקול דעתך ומול הרופא המטפל.
8. שיתוף עם רופא
כשאת/ה שולח/ת סיכום לרופא או נותן/ת לו גישה, הבחירה בנמען והאחריות לנכונות הכתובת הן שלך. לאחר שסיכום נשלח
במייל או שותף מהטלפון, העותק שנמסר לנמען אינו בשליטתנו. גישה שניתנה דרך האפליקציה ניתנת לביטול בכל רגע (עוד ←
גישת רופא).
9. קניין רוחני
האפליקציה, העיצוב, הסימן המסחרי והלוגו של GutPal, התוכן והקוד שייכים ל-GutPal או למורשיה. מוענקת לך רשות אישית,
שאינה ניתנת להעברה, להשתמש באפליקציה לצרכיך האישיים בהתאם לתנאים אלה ולתנאי חנות האפליקציות שממנה הורדת אותה.
10. עלות
כיום השימוש באפליקציה אינו כרוך בתשלום מצד המשתמש. אם הדבר ישתנה, נודיע על כך מראש, ושום חיוב לא ייעשה ללא
הסכמתך המפורשת.
11. זמינות ושינויים בשירות
אנו פועלים כדי שהשירות יהיה זמין ואמין, אך ייתכנו תקלות, הפסקות לצורכי תחזוקה או שינויים בתכונות. צ׳ק-אין שנשמר
במכשיר בזמן שאין חיבור יסונכרן כשהחיבור יחזור. ייתכן שנבקש לעדכן את האפליקציה לגרסה חדשה כדי להמשיך להשתמש בה —
למשל כשנדרש תיקון בטיחות.
12. אחריות
השירות ניתן כפי שהוא (״AS IS״). במידה המרבית שהדין מתיר, GutPal לא תישא באחריות לנזק עקיף או תוצאתי, ולא לנזק
שנגרם כתוצאה מהחלטה רפואית, טיפולית או תזונתית שהתקבלה על סמך השירות במקום התייעצות עם רופא. אין באמור כדי
להגביל אחריות שלא ניתן להגביל על פי דין, לרבות לפי חוק הגנת הצרכן, התשמ״א-1981.
13. הפסקת השימוש
אפשר להפסיק להשתמש בשירות ולמחוק את החשבון בכל רגע — ראה מחיקת חשבון. אנו רשאים
להשעות או לסגור חשבון שנעשה בו שימוש בניגוד לתנאים אלה או לדין, ונודיע על כך מראש כשהדבר אפשרי. עם סגירת החשבון
יימחק המידע כמתואר במדיניות הפרטיות.
14. שינויים בתנאים
אם נשנה את התנאים באופן מהותי, נודיע על כך באפליקציה לפני שהשינוי ייכנס לתוקף. המשך השימוש לאחר מכן מהווה הסכמה
לתנאים המעודכנים.
15. דין וסמכות שיפוט
על תנאים אלה יחולו דיני מדינת ישראל בלבד. סמכות השיפוט הבלעדית בכל עניין הנוגע להם נתונה לבתי המשפט המוסמכים
במחוז תל אביב-יפו, בכפוף לכל דין מחייב.

In short
GutPal is a personal diary for tracking symptoms, food and medications. It is not a medical service and does not replace a doctor.
Your data belongs to you. We use it only to run the service for you, as described in the Privacy Policy.

In an emergency, call 101 (Magen David Adom) or go to an emergency room. The app is not meant for emergencies.
1. General
These terms govern the use of the GutPal app and its related services (the "service"), operated by
GutPal LTD, company no. 517387551 ("GutPal", "we"). Using the service means you accept these terms and the
Privacy Policy, which forms part of them. If you do not agree, do not use the service.
2. What the service is — and is not
GutPal lets you record a daily check-in, meals and medications, compare your day against your personal range, receive
reminders, and produce an organised summary to discuss with your doctor.
GutPal is not a medical service or a medical device. It does not diagnose, does not determine a
medical condition or disease activity, and does not recommend starting, stopping or changing any treatment or dose.
The daily status ("Stable", "Sensitive", "Needs attention") summarises your own reports against your own history —
it is not a medical determination. Do not delay seeing a doctor, disregard medical advice, or change treatment
because of the app. For any medical question, contact your doctor. In an emergency, call 101 or go to an
emergency room.
The service does not promise to improve, prevent or relieve symptoms, and does not replace medical follow-up.
3. Who may use it
The service is intended for people aged 18 and over, as private individuals, for tracking their own
health only. Do not open an account for, or on behalf of, another person.
4. Your account
Give accurate details when you sign up, and keep them up to date.
You are responsible for keeping your password and sign-in details confidential. Do not share them.
If you learn of unauthorised use of your account, tell us at once at sysadmin@gutpalapp.com.
5. Acceptable use
When using the service, you may not:
try to access another user's data, bypass security measures, or disrupt the service;
use automated tools to collect data from the service, or reverse-engineer the app, except as the law expressly permits;
upload unlawful or offensive content, or information about another person without their consent;
use the service for any commercial purpose or contrary to law.
6. Your data
The data you enter belongs to you. You grant us a limited permission to use it only to run the service for you, to
secure it, and to comply with the law — as set out in the Privacy Policy. You can export or
delete all of it at any time (More → Settings). We do not sell your data or use it for advertising.
7. Insights and AI
Some features — identifying food in a photo, extracting ingredients from a meal description, phrasing food
suggestions, and suggesting questions for your doctor — use artificial intelligence and automated rules. Results may
be inaccurate or incomplete: food can be misidentified, and suggestions are based on the patterns you reported and are
not dietary advice. Every insight carries the note "This is not medical advice — share with your doctor." Weigh any
such information with your own judgement and with your doctor.
8. Sharing with a doctor
When you send a summary to a doctor or give them access, the choice of recipient and the accuracy of the address are
yours. Once a summary has been emailed or shared from your phone, the recipient's copy is outside our control. Access
granted in the app can be revoked at any time (More → Doctor access).
9. Intellectual property
The app, its design, the GutPal name and logo, content and code belong to GutPal or its licensors. You are granted a
personal, non-transferable permission to use the app for your own needs, in line with these terms and the terms of
the app store you downloaded it from.
10. Cost
The app is currently free for users. If that changes, we will tell you in advance, and you will never be charged
without your explicit consent.
11. Availability and changes
We work to keep the service available and reliable, but faults, maintenance breaks and feature changes can happen. A
check-in saved on your device while offline syncs when the connection returns. We may ask you to update the app to
keep using it — for example, when a safety fix is required.
12. Liability
The service is provided "as is". To the fullest extent the law allows, GutPal is not liable for indirect or
consequential loss, or for harm resulting from a medical, treatment or dietary decision made on the basis of the
service instead of consulting a doctor. Nothing here limits liability that cannot be limited by law, including under
the Israeli Consumer Protection Law, 5741-1981.
13. Ending use
You can stop using the service and delete your account at any time — see Delete your
account. We may suspend or close an account used in breach of these terms or the law, with prior notice where
possible. When an account is closed, its data is deleted as described in the Privacy Policy.
14. Changes to these terms
If we change these terms materially, we will tell you in the app before the change takes effect. Continuing to use
the service afterwards means you accept the updated terms.
15. Governing law
These terms are governed solely by the laws of the State of Israel. The competent courts of the Tel Aviv-Jaffa
district have exclusive jurisdiction over any matter relating to them, subject to any mandatory law.
